Terms and conditions
Rental general Terms and Conditions Agreement:
● This agreement signed or digitally approved while registering an account on ActiveshareWeb.com assumes the approval of the user whom hereinafter referred to as the “Renter” will take all responsibility for any/all damages or loss either partial or in full of the rented equipment and will be covering the full cost of repairs to be done to restore to the state of the rented equipment or tool at the time of rental, this regardless of whether the damage was caused by accident, neglect or misuse, the renter is obliged to cover the value of the rented item and hereby agrees to pay the owner the value of the equipment based on the age of the equipment at the time of rental. The rent value will be charged during the repair or dispute periods. In the case that the renter has purchased an insurance policy that would cover such matters, the renter is still liable for any damage that is not covered by the insurance policy.
● All items been listed on the Active Share Web platform are not owned by Active Share Web. We only promote items on behalf of the owners.
● Resources owner (Customer) agrees that ASW dose not have any kind of control over the method in which the resource is operated /utilized during the rental period by Renter or any third party that Renters implicitly or explicitly permits.
● *** Active Share Web covers listed equipment/tools against damage and loss during each rental period up to $ 25,000 through the Equipment Protection Plan.
● All transaction are processed through a secure third-party payment platform (the one in Canada called Stripe).
● Active Share Web shall have no obligations if Renter breaches this contract to stop the Rental Period, concern repairs or rent other equipment to Renter until Renter agrees to pay for such charges.
● Active Share Web disclaims all representations and warranties, express or implied, with respect to the Equipment, its condition, durability, or fitness for any particular purpose.
Resources Renters:
● The Renter is to review and examine the equipment or tool specification to make sure it is as per the requirement declared state, and that it is in working conditions.
● The Renter and prior to each use shall inspect the Equipment and/or any kind of resources to confirm that it is in good condition, without defects, includes readable decals and operating and safety equipment or instructions and is suitable for Renter’s intended use;
● The Renter, and during the rental period to inspect and/or perform routine maintenance on the Equipment and cleaning in accordance with the manufacture’s specifications.
● The Renter shall pay the full repair charges (other than Ordinary Wear and Tear) and rental of equipment until the repairs are completed.
● The Renter must comply with the terms and conditions for rental of the owner of the equipment/tool.
● The Renter is to provide any necessary permit or license that could be required to operate the rented equipment or tool. All listings on the site will include the legal requirements to rent the equipment.
● The renter is responsible to maintain, at its own expense insurance that covers any liabilities that could accrue during the rental periods (General Liability insurance, Property Insurance, Worker’s Compensation Insurance, Automobile Liability Insurance.
● The Renter shall provide Active Share Web (ASW) with certificates of insurance evidencing the coverages required above prior to any rental and any time upon ASW request.
● The Renter absolves Active Share Web, and the employees of Active Share Web of any and all responsibility or claim for injury, accident or damage regardless of cause that results during the rental period. Any fees including legal and attorney fees that could occur as a result of using the rented items are the sole responsibility of the Renter.
● The Renter agrees to review and understands payment conditions for each rental item, as the rental conditions may vary. Any reservation fees paid on activeshareweb.com are due and payable at the time of booking. These fees payable to Active Share Web will be deducted from the posted price and will not be refunded if the renter does not complete the request. Unless payment terms are determined by the Owner, the posted price must be pre-authorized upon confirming the transaction and before completing the final release from the owner’s side.
● The renter also will be asked to pre-authorize the rental amount plus a security deposit (what is the mechanism to calculate deposit amount) to cover damage or additional rental duration.
● The Renter shall be responsible for moving the equipment from the owner’s yard to the worksite vis versa all are in compliance with local laws. If the Renter asks for delivery services to the site address, any apparent agent at the site address is authorized to accept delivery of the equipment/resources
● The renter will arrange for the pickup of the rented items or agree to pay the owner any fees that are declared for delivery or handling of the rented item
● The renter agrees to any other terms and conditions that are visible on the Active Share Web website or are further terms documented by the owner prior to rental.
● The renter agrees to follow the owner’s instructions of operating and maintaining the item whether it is simple greasing or any maintenance that would be required to keep the item in good condition.
● During the rental period, Renter assumes all risk associated with the possession, control or use of the equipment, including but not limited to, personal injury, death, rental charges, theft, losses, damages and destruction, including Renter transportation, loading and unloading, whether or not the Renter is at fault. Accordingly shall release Active Share Web from all liabilities and damages (as stated above).
● The renter agrees to return the item in a clean state or pay the declared cleaning fees as stated by the owner. If the renter fails to return the item in a clean condition the cleaning fee(s) will be deducted from the security deposit.
● In the case where the renter wants to extend the rental period of the equipment/tool, the renter must complete a Request for Rental Extension 48 hours prior equipment return time. The owner has 24 hours to accept or deny the extension.
Resources Owners
● The Owner absolves Active Share Web, and the employees of Active Share Web of any and all responsibility or claim for injury, accident or damage regardless of cause that results during the rental period.
● The Owner is responsible to set rental rate
● The owner has the right to approve or reject any rental request without stating any reasons. The owner does not have the right to cancel or terminate any rental contract and or request the return of his property prior to the term outlined in the rental agreement.
● The Owner must have insurance policy coverage for offered equipment/resources and must be in compliance with local laws.
● There is no commitment from activeshaerweb.com until your owner items are rented,
● The Owner can message renters directly within the activeshareweb platform.
● The Owner can offer pickup and/or customized delivery options.
● The Owner can manage a listings availability through the calendar function
● The Owner can Turn off the listing during vacation or scheduled maintenance
● The Owner can utilize the Equipment Protection Plan in case the equipment is damaged or lost
● The rent period starts from the time the renter takes possession of the rented item, or from the time it leaves the premises of the owner. This will be outlined in the rental agreement. If this is not in the agreement, the renter will be responsible for equipment at the time it leave’s the owner’s premises.
● The Owner, and/or assigned representative, has the right to inspect the Equipment wherever located, and the Renter must grants the Owner and its agents the right to enter the physical location of the equipment for the specific visit purpose.
● The duration of the rent period is determined by the owner either by the hour, day, week, or month and will not be prorated unless agreed by the owner.
